Preamble




The Service provides Visitors and Members with a gay-oriented dating service for personal and leisure purposes. Access to the Service is free and strictly prohibited for minors and can be done via the website and its extension on iOS and Android applications: https://app.beuronline.com. Opening an Account allows users to become Members and access all Profiles and the free features of the Service, as well as paid Features.



1. Definitions




- Subscriber: A Member who has subscribed to one or more Subscriptions.

- Subscription: A paid plan subscribed to by a Member, providing access to the paid Features of the Service, for a period and a price specified at the time of subscription on the Service.

- CGUV: General Terms and Conditions of Use and Sale.

- Account: The Service area reserved for Members and Subscribers.

- Private Personal Information: Email addresses and passwords. This information remains strictly confidential.

- Public Personal Information: Information entered by the Member on their Profile. Some are mandatory (date of birth, photo, profile title). Others are optional (height; weight; style; ethnic origin; sexual role).

- Publisher: Studiopresse SARL

- Features: All tools accessible to Members and Subscribers through the Service to register, showcase themselves to Members, communicate with Members, and search for and select Members. Free Features are accessible to all Members. Paid Features are reserved for Subscribers.

- Member: A natural person who has opened an Account on the Service.

- Profile A space dedicated to a Member that groups the Member's Public Personal Information accessible to other Members of the Service.

- Data Controller: Studiopresse SARL

- Service: The website https://app.beuronline.com and the Applications {{ name }} available on the Apple App Store and Google Play Store.

- Associated Service: The website https://app.beuronline.com and its iOS and Android applications. The profiles of the Service Members and those of the Associated Service are shared and form a single Member base, accessible to all Members, whether registered on the Service or the Associated Service.



2. Purpose




The purpose of this document is to define the general terms and conditions of use and sale offered by the Publisher to its Members. Acceptance of the CGUV formalizes the conclusion of the membership contract to the Service binding the Member and the Publisher. The Service provides its Members with free or paid Features that facilitate contact and correspondence with other Members for entertainment and personal communication purposes. The Publisher cannot guarantee that exchanges between Members will actually lead to virtual or real meetings. Each Member is free to discuss and establish relationships with other Members in compliance with these T&Cs. In no case can the Service be assimilated to advisory activities or matrimonial brokerage. It is solely intended to facilitate meetings based on the location and preferences of Members, among those who have a mutual interest.



3. Prerequisites




Members declare that they have obtained from the Publisher all the necessary information regarding the Features and Subscriptions offered and adhere to these General Terms and Conditions of Use and Sale (CGUV) without any restrictions or reservations. Members acknowledge that using the Service requires compliance with all the requirements defined within these CGUV. Members may benefit from the Features offered to them on the Service, provided, where applicable, that the relevant Subscription is paid for and the following prerequisites are met:



- Be of legal age (i.e., at least eighteen years old) on the day of registration on the Service;

- Have the legal capacity to commit to these CGUV;

- Have suitable computer equipment to access the Service;

- Have a valid email address.



4. Scope




These CGUV apply to the creation of an Account on the Service by a Member and to any Subscription taken out by a Member with the Publisher. The Member is required to review the CGUV before creating an Account and subscribing to any Subscription. The choice and purchase of a Subscription is the sole responsibility of the Member. The Member declares that they have read and accepted these CGUV before creating an Account and/or subscribing to a Subscription online. Unless proven otherwise, the data recorded in the Publisher's computer system constitutes proof of all transactions concluded with the Subscriber through the Service. The validation of a Subscription by the Subscriber constitutes acceptance without restriction or reservation of these CGUV.



5. Updates to the CGUV




The Publisher reserves the right, at any time and unilaterally, to supplement or modify these CGUV in any way it deems necessary, or to terminate the Service. The modified CGUV will be subject to the Member's agreement when they connect to the service. It is the Member's responsibility to carefully read the CGUV when they are updated and to fully understand the changes brought about by the update. The fact that the Member continues to use the Service after the CGUV have been updated constitutes acceptance without reservation of the modifications made to the CGUV. In case of disagreement with the modifications of the CGUV, the Member has the option to unsubscribe from the Service and terminate their Account in accordance with Article 17.



6. Registration on the Service and Opening an Account




6.1 Prerequisites.




To register and thus become a Member, any visitor interested in the Service must meet the following conditions: be at least 18 years old, have read and accepted these Terms of Use, including the Privacy Policy defined in Article 15.1 and the Cookie Policy defined in Article 15.2, have explicitly consented to the processing of their sensitive personal data by the Data Controller, have completed the mandatory fields in the registration form, and have explicitly consented to the publication of their Profile on the Associated Service.



6.2 Mandatory and Optional Personal Information




The mandatory personal information required to open a Member account includes: a valid email address; a password; a date of birth; a photo that may represent the Member or anything else they choose; a profile title. All other data entered by the Member on their Profile is optional.



6.3 Private and Public Personal Information.




The email address and password are strictly private, and their dissemination by the Publisher to other Members is expressly prohibited. The other mandatory personal information and optional personal information are considered Public Personal Information intended to be shared with other Members on the Service and with Members of the Associated Service on the Associated Service.



6.4 Member Responsibility




The Member or Subscriber is responsible for the use of identification elements by third parties or for actions or statements made through their Account, whether fraudulent or not, and indemnifies the Publisher against any claims in this regard. Furthermore, the Publisher is not obliged to, nor has the technical means to, verify the identity of individuals registering for the Services. If the Member has reason to believe that someone is using their identification elements or their Account, they must immediately inform the Publisher.



6.5 Facebook Connect




Visitors are offered the option to use their Facebook personal user account information to avoid filling out the registration or login form fields on the Service. No information regarding their registration on the Service will be displayed on the visitor's Facebook account, and the email address is the only personal data of the Member transmitted by Facebook to the Publisher.



6.6 Profile Pending




Once registered, the Member's profile is displayed as "pending": during this period, which varies in length, the Member's profile is reviewed by the Publisher to ensure that the data provided by the Member complies with these CGUV. In case of non-compliance with the CGUV, the Member is informed by email of the rejection of their profile and is offered the opportunity to modify it. If the Member does not modify their profile in compliance with the CGUV, the Publisher reserves the right to permanently refuse it. The Publisher is not obliged to, nor has the technical means to, verify the identity of individuals registering on the Service and opening an Account.



6.7 Communication with the Member




The Member may consent to receive notifications on their smartphone to be notified of important events, including, but not limited to, a message received from another Member or the Publisher. This consent can be withdrawn at any time from the mobile phone settings. When the Member confirms the validity of their email address, they are offered the option to consent to receiving a weekly newsletter from the Publisher informing them of new Profiles available on the Service. If they register, the Member may unsubscribe at any time from their Account if applicable. The Publisher is free to display advertising and/or promotional messages from advertisers and other partners on the Service. The Member expressly consents to receiving such messages.



7. Subscription and Cancellation of a Subscription




7.1 Payment Terms for Subscriptions




To subscribe to a plan, the Member must first create their Account, choose their subscription, and select a payment method. These rates are fixed and not subject to revision during the subscription period. The price is payable in full at the time of subscription by credit card.



7.2 Paid Features




Subscribing to a plan allows access to advanced search features.



7.3 Cancellation




To cancel their subscription, the Member must go to the "my subscription" section of their Account, or, in the case of a subscription made on the App Store, to the settings section of their Apple device dedicated to purchases.



8. Right of Withdrawal




In accordance with Article L.221-18 of the Consumer Code, the Member has the right to withdraw within fourteen (14) calendar days from the conclusion of the sale, without giving any reason and without any payment being due. To withdraw, the Member will send their request by email to [email protected]. In accordance with Article L-221-25 of the Consumer Code, the Member who has started using the service (in this case, exchanging messages with other Members) before the end of the withdrawal period shall pay the professional a sum corresponding to the service provided up to the communication of their decision to withdraw.



9. Obligations of the Publisher




9.1 Quality of Services




The Publisher strives to provide high-quality Features. It allows Members to use the communication tools made available to them under the best possible conditions. Due to the nature and complexity of the Internet network, particularly its technical performance and response times for consulting, querying, or transferring data, the Publisher makes its best efforts, in accordance with industry standards, to allow access to and use of the Service. The Publisher shall not be responsible for the proper functioning of the Member's computer equipment or their internet access.



9.2 Maintenance and Updates




The Publisher makes its best efforts to provide Members with efficient Features and to maintain the Features in optimal operating conditions. The Publisher reserves the right to temporarily close access to the Features, particularly for updates, maintenance operations, modifications, or changes to operational methods, accessibility hours, without this list being exhaustive. The Publisher is not responsible for damages of any kind that may result from non-operation, inability to access, or poor conditions of use of the Features due to unsuitable equipment, internal malfunctions of the Member's internet provider, internet network congestion, and for any other external reasons considered force majeure. The Publisher reserves the right to supplement or improve, at any time, the Service, Subscriptions, and the Features available there, depending on technological developments, and will inform Members by any means.



9.3 Moderation




The Publisher is under no obligation to monitor, moderate, or control exchanges and content posted on the Service by registered Members. The Publisher does not intervene directly on the content of profiles. During the Member's registration and subscription process, the Publisher ensures compliance with these Terms and Conditions (CGUV) but does not verify the authenticity or validity of the information provided, nor does it monitor any subsequent changes to the profile made by the Member. The Publisher does not intervene in the relationships and exchanges between Members. The Publisher undertakes to act when illicit content, behavior, or use, or non-compliance with these CGUV, is reported to it in accordance with the "notification of illegal content" article herein or flagged using the "report abuse" link found on the profile of each registered Member. The Publisher takes the measures it deems most appropriate to the situation. The Publisher reserves the right to remove any content that does not comply with these CGUV, after having informed the concerned Member, if conditions permit.



9.4 Security




The Publisher makes its best efforts, in accordance with industry standards, to secure the Service. Given the exponential nature of technological advancements, the Publisher cannot guarantee absolute security of the Service or the absence of flaws.



10. Obligations of the Members




10.1 Reliability of Profiles




The Member undertakes to provide personal information that complies with laws and regulations. The Member shall not share their Account with others or give access to their Account to a minor. They are also prohibited from engaging with a Member who is found to be a minor, despite the requirement that all Members must be of legal age. The Member is prohibited from providing, during registration or through profile updates, any identification data that is impersonated from a third party. Public data posted by the Member must comply with public decency standards: no sexually suggestive photos or photos of minors. The Member is forbidden from including any telephone, postal, or electronic contact information on their profile. It is also strongly discouraged to send money, by any means and for any reason, to another Member.



10.2 Proper Use




The Member is responsible for using the Features on the Service. They agree to use the Service fairly, in compliance with these CGUV. The Member’s behavior when using the Features must respect good conduct rules. The Member is prohibited from making any statements that infringe on others' rights, are defamatory, abusive, or generally any statements or content contrary to the Service's purpose, laws, and regulations in force. The Member is prohibited from disseminating, in any form, information or content containing links to third-party sites that are illegal, contrary to public decency, and/or not in line with the Service's purpose. The Member agrees to report any obviously illegal content in accordance with the procedure provided in the "notification of illegal content" article of these CGUV. The Member may also report to the Publisher the profile of a Member who does not comply with these CGUV using the "abuse" link on each registered Member’s profile. The Member is prohibited from engaging in any illegal or fraudulent behavior towards the Publisher, other Members, or third parties. Any violation by a Member of any of these obligations constitutes a serious breach. Any behavior that does not comply with the above-mentioned good conduct rules may be sanctioned under the conditions of the "termination" article of these CGUV.



10.3 Security




The Member is prohibited from accessing or remaining, fraudulently, in any part of the Service. They are forbidden to use an access method other than the interface and instructions provided by the Publisher. If the Member discovers such a method or enters a restricted area without authorization by accident, they must immediately inform the Publisher at the following address. The Member is prohibited from deleting or modifying data contained on the Service or introducing fraudulent data or even altering the operation of the Service. They must especially avoid introducing viruses, malware, or any other harmful technology into the Service or the Features offered there. Any intentional access to a prohibited area will be considered fraudulent access under the provisions of the penal code. The Member agrees to consider all data they have accessed in a non-authorized area as confidential and undertakes not to disclose it. The Member takes all measures to ensure their own security, particularly the management of their login details and passwords, which they keep confidential.



10.4 Combating Sexual Abuse and Child Exploitation




Members commit to preventing the risk of their account being used by a minor (a person who has not reached the legal age of majority in their country).

Members agree not to share photos depicting minors, even with their consent, and not to make any references to minors or acts involving minors in their interactions with other members on the service.

Members commit to reporting to the service administrator any member suspected of being a minor or any content that may depict or reference minors via the contact form https://www.beuronline.com/en/contact or by email at [email protected].



11. Technical Support




The Publisher provides Members with a customer service that can provide all necessary information for using the Service and its Features. The Publisher makes its best efforts to provide accessible Features to all Members under optimal conditions. The Publisher cannot guarantee absolute technical compatibility of the functionalities and Features it offers, as their proper functioning depends on the software and hardware compatibility of the computer equipment used by the Members. If a Member experiences difficulties accessing and/or using any of the Features provided by the Service, they can contact customer service at any time at [email protected] or from 9 a.m. to 6 p.m. at +33.1.86.95.34.53.



12. Intellectual Property




12.1 Elements of the Service or Licensed by Third Parties




These Terms and Conditions of Use do not entail the transfer, to the benefit of the Members, of intellectual property rights on elements owned by the Publisher or licensed to it by third parties. The content of the Service, the names of the Services, trademarks, designs, models, images, texts, photos, logos, graphics, sounds, videos, domain names, or any other information or material presented by the Publisher on the Service, without this list being exhaustive, are the exclusive property of the Publisher and are protected by applicable French and international intellectual property laws. Any reproduction and/or representation, in whole or in part, of any of these elements, without the prior express authorization of the Publisher, is prohibited and would constitute an infringement sanctioned by articles L. 335-2 et seq. of the Intellectual Property Code. Consequently, the Member is prohibited from any actions that may directly or indirectly infringe on the Publisher's intellectual property rights. The Member may not in any case use, print, or reformat the content of the Service for purposes other than private or personal use. They agree not to download, reproduce, transmit, sell, distribute, or exploit the content of the Service.



2.2 Public Personal Information and Content Uploaded by the Member




The Member grants, as needed, the Publisher a license to use the intellectual property rights attached to the content they upload to the Service (photos, images, sounds, videos, text) of which they hold exclusive ownership and which are protected by applicable French and international intellectual property laws. This usage license granted by the Member to the Publisher for the non-exclusive purpose of supporting its communication efforts to other Members covers the right for the Publisher to reproduce, represent, adapt, translate, digitize, and use the Public Personal Information and content uploaded by the Member on the Service, on the Associated Service, and on any electronic communication medium within the framework of the Service's Features (including newsletters reserved for Members of the Service, push notifications, and the Service's social media accounts). The Member authorizes the Publisher to modify these elements to comply with its graphic charter or to make them compatible with its technical performance or any format of support provided within the Service. The usage license is granted by the Member to the Publisher for the entire world and for the duration of the online availability of these elements due to the Member. The Member agrees to take all necessary measures to protect these rights against all third parties and indemnifies the Publisher from all claims or damages that could result from the violation of a third party's rights.



13. Liability




In the context of providing the Services, the Publisher is subject to an obligation of means. In accordance with the legislation in force, the Publisher cannot be held civilly liable for the activities or information stored at the request of the Members, except in the case where the Publisher has been duly notified of the existence of illegal content under the conditions of the article "Notification of Illegal Content" of these Terms and Conditions and has not acted promptly to remove it. Members acknowledge and accept that the elements they provide, as well as their behavior or statements on the Service, may be subject to reporting by other Members and to post-review by the Publisher, without prejudice to the application of the article "Termination" of these Terms and Conditions. The Member acknowledges and accepts that the disclosure of information by them on the Service is their sole responsibility, and waives any recourse against the Publisher, particularly on the grounds of their right to image, honor, reputation, or privacy resulting from the dissemination by them of this information, except in the event of proven fault by the Member. The Member is solely responsible for any damages caused by the disclosure of such information. The Member indemnifies and holds the Publisher harmless against any claim and any judgment resulting from a breach by the Member of the obligations incumbent upon them under the law or these Terms and Conditions. The Member cannot hold the Publisher responsible for any delay in the information that will be transmitted to them. The Publisher's liability cannot be sought in the event of fraudulent or abusive use or due to voluntary or involuntary disclosure to anyone of the Member's login credentials. The Publisher cannot be held responsible for the violation of these Terms and Conditions by a Member, nor for their actions on the Service, whether or not they constitute a fault. Interactions between Members, profiles, descriptions, and other announcements are intended for entertainment and communication purposes. The Publisher can in no way be held responsible for meetings on or off the Service or for correspondence between Members. Partner websites may be accessible to Members through hyperlinks, such as advertising banners. The Publisher cannot be held responsible for the data and information disseminated by their potential business partners.



14. Notification of Illegal Content




Any notification of illegal content must necessarily indicate the following information, in accordance with Article 6 I 5° of Law 2004-575 of June 21, 2004: The date of the notification. If the notifier is an individual: their surname, first name, profession, domicile, nationality, date, and place of birth; if the applicant is a legal entity: its form, name, registered office, and the legal entity that represents it; The name, first name, and domicile of the recipient or, if it is a legal entity, its name and registered office; A description of the disputed facts and their precise location (with a copy of the precise URL address of the content); The reasons for which the content should be removed, including references to the legal provisions and factual justifications; A copy of the correspondence sent to the author or publisher of the disputed information or activities requesting their interruption, removal, or modification, or justification that the author or publisher could not be contacted. The Member must notify such content by complying with the information provided in this article by sending an email to the following email address: [email protected]. It is recalled that any person who presents content or an activity as illegal with the aim of obtaining its removal or stopping its dissemination, while knowing this information is inaccurate, is punishable by a one-year prison sentence and a €15,000 fine under Article 6, I, 4° of Law No. 2004-575 of June 21, 2004.



15. Termination of the Contract and Account Closure




15.1 Account Closure by the Member




The Member may decide to permanently delete their Account at any time in the "my settings" section of their account. Their Account will be permanently deleted, including the rights acquired to paid services registered on their Account, which will be lost and non-refundable. The contract will be terminated, and the Member's data will be retained for the data retention period defined in Article 15.1, then permanently deleted at the end of this period.



5.2 Account Closure by the Publisher in the Event of a Member's Breach of the Terms and Conditions




In the event of a Member's breach of the Terms and Conditions, their Account may be suspended at any time as a precaution or automatically closed by the Publisher. The Member whose Account is suspended will be informed of this decision by the Publisher by email. The Member's data will be retained for the data retention period defined in Article 15.1, then permanently deleted at the end of this period. The rights acquired on paid services registered on the Member's Account at the date of termination will be permanently deleted, with no possibility of refund. The Member will not be able to reopen an Account for a period of 3 years from their last login.



15.3 Closure of Inactive Member Accounts by the Publisher




An Account is considered inactive if no login is recorded for a continuous and consecutive period of 3 years. The Member will be informed by email, at the address they have provided in their account, of the deletion of their Account with a notice period of 8 days. The Member can reactivate their Account at any time during the notice period, which will suspend the termination procedure.



16. Disputes - Mediation




These Terms and Conditions are governed by French law. Any disputes arising from the creation of an Account, the purchase of services, their execution, or their termination that could not be resolved between a Member and the Host will be submitted to the competent French courts under the conditions of common law. The Member is informed that they can, in any event, resort to conventional mediation, particularly with a consumer mediator. The Member may also submit any complaints on the dispute resolution platform provided by the European Commission at the following address: https://ec.europa.eu/consumers/odr. The European Commission will forward the Member's complaint to the competent national mediators.



17. Miscellaneous




These Terms and Conditions constitute the entire agreement between the Member and the Host concerning the use of the Service and replace in their entirety all previous agreements between the Member and the Host related to the Service. If any term of these Terms and Conditions is found to be void by any court of competent jurisdiction, that term will be deleted without affecting the other terms of the Conditions. The remaining terms will remain valid and enforceable.
